Art. 1 - General Conditions
1.1 These general terms and conditions of sale shall apply to the purchase of the brand products sold by MareBeachwear.com via the e-commerce website www.marebeachwear.com (hereafter the “Site”) by users falling within the definition of “Consumers”. This website is property of

1.2 Before proceeding to purchase Products on MareBeachwear.com, the User is recommended to consult these General Terms and Conditions of Sale, that in the case of purchase are therefore deemed to be accepted.
1.3 The Purchase Contract may be closed at the Customer's choice in any of the two languages spoken on this Website: Italian; English
Art.2 - Subject
2.1 MareBeachwear is a Retailer online that distributes and sells to the Final Consumer the following Products type: - beachwear garments - swimsuits, coverups and beach accessories - underwear and corsetry pieces fall-winter clothing pieces
2.2 Products are sold with the characteristics described on the Site and according to the general conditions of sale published at the time the order is placed by the Consumer, with the exclusion of any other condition or term. The essential characteristics of the Products are presented on the Website within each product page. The images and colors of the Products on sale on the Website may however slightly change and/or not be exactly corresponding to the real ones, due to the internet browser and the monitor used by the Consumer.
2.3 The prices of the Products for sale on the Website include the Italian VAT, and their characteristics too may be subject to change without preventive notice. These changes are valid for orders not yet confirmed at the date of the change only.
2.4 The availability of the Products indicated on the Website refers to the actual availability at the time Customer places its order. In any case, this availability must be considered indicative because due to the simultaneous presence on the Website of several Users Products could be sold to other Clients before confirming the order. Where the ordered products are not available, the order will be automatically deleted, the Customer advised via email and refunded of any amount He/She paid to MareBeachwear.com.
2.5 The Products available on the Website can be purchased and delivered in all the Countries of the World, according to the times and shipping costs s set out in art. 4 of this Text.
Art. 3 - Completion of the contract and Payments
3.1 Once the Customer has identified the desired Products, He/She has to insert them into the shopping cart and then proceed with the Purchase. To place the order, the Customer must follow the guided purchase process and click on the "Place order" button. After the payment is complete, the Customer will receive an e-mail with the confirm that the order has been placed.The e-mail contains customer's data, the order number, the price of the goods purchased, shipping costs and the delivery address to which goods will be sent.
3.2 The following methods of payment are accepted by Marè Beachwear:
3.2.1 Credit Card: When clients place orders online, Credit Card details are forwarded to a protected online banking system provided by Banca Sella and WorldPay which accept Visa, MasterCard, JCB, American Express and Carte Bleu. Please visit: www.sella.it and www.worldpay.com for further information. Marè Beachwear clients are guaranteed maximum Credit Card security because all transactions are processed using a secure server. Marè Beachwear Customer Service will not request or accept credit card numbers and/or expiry dates. Marè Beachwear advises Clients to apply for E-commerce security PIN CODES provided by Verified by Visa and SecureCode by MasterCard. For more information, please visit www.visa.com or www.mastercard.com. If there are sufficient funds and the account information is valid, the order will be processed instantly. Credit cards are charged at the moment that the order is confirmed for both available merchandise and for Pre-order items (which are shipped later in the season when the merchandise arrives).
3.2.2 Bank wire transfer: When Bank Wire Transfer is selected at the order confirmation as the method of payment, the customer will automatically receive a message confirming the account information for Marè Beachwear. The merchandise will then be reserved for the order and shipped once the funds are deposited in Marè Beachwear’s bank account. It is mandatory that the Client send an email to firstname.lastname@example.org with the scan of the bank transaction within 24 hours for confirming the order. Merchandise will be shipped once the funds have reached Marè Beachwear’s bank account. If the scan or fax of the bank transaction is not received within 24 hours of the request, the order will be cancelled. The merchandise will be shipped once Marè Beachwear has received the funds. 3.2.3 PayPal: Marè Beachwear welcomes payments from PayPal Accounts and reserves the right to process orders only if shipped to the same address that the verified Paypal account is registered with.
3.2.4 Cash on Delivery: This service has a cost of 16 euros. You will pay the freight forwarder at delivery with cash (the courier does not accept cheques nor fives any change). Please note that this payment method is only available for amounts up to 2.999,00 euro. If the shipment of a parcel does not end well due to customers’ faults, Marè Beachwear has the right to refuse this payment method at the next (if any) order. If you choose this payment method, you have to have a bank or post account for a possible refund in case of return.
Art. 4 - Shipping times and costs
4.1 Marè Beachwear ships all over the world by UPS and DHL Couriers. Usually, all orders are shipped within 1 business day. Orders placed after 2pm (CET) on Fridays are shipped on the following Monday. Orders shipped outside EU zone are exempt from Italian VAT but might provide for customs duties and import taxes depending on the Country, which are the sole responsibility of the Customer.
US Orders up to 800 USD are exempt from duty and import fees. Orders to Canada are exempt from duty and import fees.
4.2 National Shipping (Italy): shippings to Italy are always free of charge. Shipments to Italy, San Marino and the Vatican City will be shipped via the courier UPS Italia Srl and DHL International GmbH courier. Our estimated delivery date for your order is 24/48 hours.
4.3 International Shipping: All orders will be shipped by DHL International GmbH courier or via UPS Italia Srl. The shipping cost varies by zone:
Europe Euro zone: €15
Europe extra Euro zone: €25
U.S. and Canada: €30
Rest of the world: €45

The estimated delivery time for orders shipped to Europe is 2-3 working days from the date of dispatch, while is 2-4 working days for orders shipped to the rest of the world. Marè Beachwear is not responsible for any delays due to customs.
Art.5 - Right of withdrawal
5.1 In accordance with the provisions in force, the Customer has the right to withdraw from the purchase. If for any reason the customer was not satisfied with the purchase, the unworn items can be returned for size change, store credit or refund. The return shipment must be made within 15 days from the date of receipt of the goods and strictly managed by the courier indicated in MareBeachwear.com return authorization. Customers have to officialy ask for the return at the following page:
5.2 General terms and conditions: The goods must not have been worn, washed or altered and must not show any signs of use. The soles of the shoes must be in perfect condition and show no signs of any kind. Each item must be returned including all labels, packaging and accessories provided with the order received, and must not have been in any way damaged and/or altered, or used as a single outer packaging. In the event that the customer receives damaged goods, or as a result of shipping issues from Marè Beachwear's end, the customer is required to follow the instructions above. Marè Beachwear reserves the right to request photographic evidence before allowing returns for damaged goods and paying the shipping costs for the return. Swimwear and underwear (Bikini, briefs, boxers, etc.) should be tried on while wearing underwear. The returns of these items will be refused and returned to the customer in case the transparent label of hygiene protection has been removed, or if the goods show signs of use. Marè Beachwear reserves the right to reject unauthorized returns, or goods returned by couriers that differ from the one indicated in the return instructions. Acceptance of these will in any case incur a charge equal to 10% of the value of the returned goods. Marè Beachwear does not accept the returned goods if the return does not comply with all terms and conditions provided for by the return policy. In these cases the goods will be returned to the sender to the original shipping address provided by the customer. With regards to the matters not specifically stated, please refer to the European Distance Selling Regulations.
5.3 Three types of Return are possible:
5.3.1 Size exchange: No return shipping fee is charged. Items can be exchanged only when a different size or a different color of the same Item Code is available. Exchanges for a different Item code are currently unavailable. The Free Return policy is limited to one exchange. It is currently not possible to exchange size for orders outside the EEC.
5.3.2 Store credit: No return shipping fee is charged. As soon as the item come back to our warehouse, Marè Beachwear will send the customer a code for the amount of the returned items. The store credit:
• it can be used only once on a future order within three months of the return;
• it is not cumulative with other store credits;
• it must be used in its entirety on an order that is either equal to or greater than the value of the store credit.
5.3.3 Refund: If the customer wishes to return the goods for a refund, the return shipping expenses (return shipping costs are 10 € within Italy while they will be equal to the outbound shipping costs for orders shipped to other countries) and any other import tax will be the sole responsibility of the customer. These costs will be deducted from the partial refund. Refunds will be processed as soon as returned items have been checked and accepted. For orders paid by credit card, the refunded amount will be available to customers in roughly 15 days and within their next billing statement. Processing time may vary depending on the credit card company. Orders paid by Paypal or by bank transfer will be refunded to the original account. Returns must be shipped within 15 days of the order delivery date. Shipping of returned items is free of charge only for size exchange and store credit. Any expenses related to import taxes will be deducted from the final refund.

7.1. These General Conditions of Sale are subject to the Italian law. In any case the rights eventually attributed to Consumers by mandatory provisions of the law in force in the State of the latter will be maintained. Any controversy that does not find a friendly solution will be submitted to the non-exclusive jurisdiction of the Court of Treviso.
7.2. Furthermore, the Customer can also apply to the courts of the European Union Member State of His/Her residence or domicile.
7.3. For the resolution of any disputes arising in the interpretation and execution of these conditions of sale, in according to the Italia D.Lgs 28/2010 the Consumer may also optionally resort to the procedures of mediation by accessing the following site: https: // webgate.ec.europa.eu/odr.
